Terms of Service

These Terms of Service ("Terms") govern your use of RhetorX (the "Service"), operated by Fulton Media LLC ("we," "us," "our"). By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms.

1. The service

RhetorX analyzes transcripts of talks, sermons, podcasts, and presentations that you provide, and returns structured, timestamped coaching feedback generated with the assistance of third-party AI models. The Service is intended to help you improve your own delivery and communication — it does not write, ghostwrite, or generate content on your behalf.

2. Your account & license key

Access to the Service is tied to a license key issued at signup. You're responsible for keeping your license key confidential. Your key is personal to your subscription — please don't share it or resell access. If you believe your key has been compromised, contact us and we'll issue a replacement.

3. Subscriptions & billing

Subscriptions are billed on a recurring basis (monthly or annual, depending on the plan you select) through our payment processor, Lemon Squeezy. By subscribing, you authorize recurring charges to your payment method until you cancel. You can manage or cancel your subscription at any time through the Lemon Squeezy customer portal linked in your welcome email and account communications.

4. Your content

You retain all ownership rights to the audio recordings, transcripts, and other materials you submit ("Your Content"). By submitting Your Content, you grant us a limited license to process it — including compressing, transcribing, and analyzing your audio — solely for the purpose of generating your coaching report and maintaining your report history. We do not sell, share, or use Your Content to train AI models, and we do not use it for any purpose beyond providing the Service to you.

5. Acceptable use

You agree not to use the Service to:

• Submit content you don't have the right to submit (e.g., someone else's talk without permission)
• Attempt to reverse-engineer, scrape, or extract the Service's underlying prompts, rubric, or analysis methodology
• Use the Service in any way that violates applicable law
• Circumvent usage limits or licensing restrictions

6. About the AI-generated feedback

Coaching reports are generated using AI and are intended as a supportive tool, not a substitute for professional coaching, editorial, medical, legal, or other professional advice. Feedback may occasionally be inaccurate or incomplete. Use your own judgment when applying any suggestion.

7. Ownership

The Service itself — including its software, design, coaching rubric, and analysis methodology — is the property of Fulton Media LLC and is protected by applicable intellectual property law. Nothing in these Terms transfers any ownership of the Service to you.

8. Cancellation & termination

You may cancel your subscription at any time; access continues through the end of your current billing period. We reserve the right to suspend or terminate access for violations of these Terms, including abuse of the acceptable use section above.

9. Warranty disclaimer

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability.

10. Limitation of liability

To the fullest extent permitted by law, Fulton Media LLC's total liability arising from your use of the Service is limited to the amount you paid us in the twelve months preceding the claim.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email or posted on this page with an updated date above. Continued use of the Service after changes take effect constitutes acceptance.
